Terms of use

Introduction :

The Terms of use are there to make you aware of the rules that apply when you use the app or benefit from any of its products, services or features.

To use the application and benefit from its services, you must accept these conditions. Therefore, by creating a user profile or account on the application and/or by using the application and its services, you become a user and you agree to comply with the obligations described in this document and in the Privacy Policy which we encourage you to read. . Of course, if you do not agree with one or more of the rules they contain, you are free not to register on keepture.

1. Who can use the application:

Persons under the age of 13 are not permitted to create an account or use the Services. If you are under 18, you may only use the Services with the prior consent of your parent or legal guardian. Please ensure that your parent or legal guardian has reviewed and discussed these Terms with you before you begin to use the Services.

2. Your account:

To use certain Services, you must create an account. You agree to provide us with accurate, complete and up-to-date information on your behalf. You are responsible for all activity on your account. It is therefore important to take care to maintain the security of your account. If you believe someone has accessed your account, please contact support immediately (support@keepture.fr). Any software we provide to you may automatically download and install upgrades, updates, or other new features. You can set and adjust these automatic downloads in your device settings. You agree not to create an account if we have previously removed or banned you or your account from any of our services, unless otherwise agreed by us.

3. Your rights and commitments:

​

The User must make authorized and normal use of the Application and the associated Services and acknowledges that Keepture may put in place measures to prevent any manifest misappropriation of the purpose of the Services. You must therefore use the Application in compliance with the applicable law and regulations and will be solely responsible for the use you make of the Application. You must also comply with the general conditions of use and access to the Application.

Keepture grants you a personal, royalty-free, non-exclusive, limited, non-transferable, revocable, worldwide license for the sole purpose of allowing you to access the Services. As a User, you undertake to use the App and the Services in good faith, in compliance with the Conditions, and by adopting responsible behavior so as not to divert their purposes through inappropriate use or harm others.

You expressly agree not to:

  • Otherwise violate the rights of third parties or applicable laws and regulations.

  • Use any trademarks, logos, designs, photos, videos or other materials appearing on our Services;

  • Copy, archive, download, distribute, publish, broadcast, perform, display, make available, or use all or any part of the Services (or the content of the Services), except as permitted in these Terms;

  • Use the Services for commercial purposes without our consent.

4. Security:

To keep the App a safe space, you agree not to:

  • Transmit a computer virus, worm, Trojan horse, logic bomb or any other malicious file, program or form of code, intended to damage, interrupt, suspend, destroy and/or limit the functionality of any computer or telecommunications equipment.

  • Impersonate another person, another User or an employee or representative of Keepture, and/or use the App to send or transmit any content that could harm or disparage Soons of any way.

  • Use any data mining tools, robots or similar tools to gather and extract data related to the App.

  • Interfere with the operation of the App, servers and/or network connections to the App.

  • Violate any requirements, procedures, policies or regulations relating to networks connected to the App.

  • Modify, adapt, sublicense, translate, sell, reverse engineer, decompile or disassemble any part of the App.

  • Attempting to gain unauthorized access to the App (or any part of it).

  • Use devices or software to interfere or attempt to interfere with the proper functioning of the Application; or implement actions that would impose a disproportionate load on our infrastructure.

5. Respect for other Users or third parties:

​

You may not use the Services, tools provided by the Services, or any content on the Services, or authorize anyone else to use them. :

  • in a way that impersonates another person 

  • in a way that violates or infringes another person's publicity rights, right to privacy, copyright, trademark law or other intellectual property right.

  • in a way that is defamatory, abusive, intimidating, harassing, malicious, obscene, inciting discrimination, hatred, racist, xenophobic, anti-Semitic, glorifies war crimes, may incite the commission of a crime, an offence, an act of terrorism, is contrary to the safety of minors;

  • in a way that solicits Users or allows them to be sent unwanted messages.

  • for advertising or commercial purposes or likely to unfair competition, in order to publish or facilitate the transmission of advertising, commercial solicitations, spam, "chain letters", "pyramid schemes" or to collect information, data or Content on d other Users without their authorization.

6. Confidentiality:

Your privacy is important to us. You can learn more about how your information is processed when you use our Services by visiting our Privacy Policy.

 

7. Third Party Content:

​

Much of the content on our app is generated by users and other third parties. Whether such content is publicly posted or privately sent, the content is the sole responsibility of the user or entity that sent it. Although Keepture reserves the right to review or remove any content that appears on the Services, we do not necessarily review it in full. We therefore cannot guarantee that other users or the content they provide through the Services will comply with our Terms or our Community Guidelines.

 

8. Modification of services and termination:

We are constantly improving our Services and creating new ones all the time. This means that we may add or remove features, functionality or products and that we may also temporarily or permanently suspend all Services. We may take any of these actions at any time and for any reason, and when we do, we may not be able to give you prior notice.

9. Disclaimer:

​

We make sure the Services work without inconvenience. But we do not promise to achieve this.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", TO THE MAXIMUM EXTENT PERMITTED BY LAW AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, OWNERSHIP AND NON-INFRINGEMENT. FURTHER, WHILE WE STRIVE TO PROVIDE A GOOD USER EXPERIENCE, WE DO NOT REPRESENT OR WARRANT THAT: (A) THE SERVICES WILL ALWAYS BE SECURE, ERROR-FREE, OR TIMELY; (B) THE SERVICES WILL ALWAYS OPERATE WITHOUT DELAYS, DISRUPTION, OR OTHER DEFECTS. OR (C) THAT ANY CONTENT, USER CONTENT OR INFORMATION YOU OBTAIN ON OR THROUGH THE SERVICES WILL BE TIMELY OR CORRECT.

WE DO NOT OWN NOR ASSUME RESPONSIBILITY FOR ANY CONTENT THAT YOU, ANY OTHER USER OR A THIRD PARTY CREATE, UPLOAD, POST, SEND, RECEIVE OR STORE ON OR THROUGH OUR SERVICES. YOU UNDERSTAND AND AGREE THAT YOU MAY BE EXPOSED TO OFFENSIVE, ILLEGAL, MISLEADING OR OTHERWISE INAPPROPRIATE CONTENT FOR ANY REASON WHICH WE OR OUR AFFILIATES ARE NOT RESPONSIBLE FOR.

10. Dispute resolution

​

Keepture provides Users with a support service accessible through a contact form accessible via the Application or the Website at the following address: support@keepture.fr. keepture undertakes to respond to any dispute within 30 working days from the date of receipt thereof. 

In the event of a dispute arising from the interpretation or execution of the Contract, the parties shall endeavor to seek an amicable solution.
